Terms of Use

1. Acceptance

By using the app or website, creating an account, starting a guest session, purchasing a subscription, or accessing generated content, you agree to these Terms, the Privacy Policy, the AI & Safety Notice, and any in-app notices. If you do not agree, do not use TheraTale.

2. Adult and Parent/Guardian Responsibility

TheraTale is designed for adults with children, not for unsupervised child account management. You represent that you are at least 18 years old or the age of majority in your jurisdiction and that you have authority to use the service for the child.

You are responsible for deciding whether any story, image, narration, suggestion, or app experience is appropriate for your child and situation.

3. Nature of the Service

TheraTale is a creative mobile storybook app for entertainment, imagination, shared reading, and parent-child connection. It does not guarantee behavioral, educational, psychological, health, parenting, or safety outcomes.

4. Not Professional Advice; No Emergency Use

TheraTale is not therapy, medical care, diagnosis, treatment, mental health service, educational assessment, legal advice, emergency service, crisis service, or professional counseling.

AI-generated content may be incomplete, inappropriate, outdated, or wrong. Important information should be independently checked. Do not rely on TheraTale for health, safety, law, finance, education, abuse, self-harm, violence, emergencies, or any serious risk.

If a child may be in danger, harmed, at risk of self-harm, experiencing abuse, facing violence, or needing medical or mental health support, contact local emergency services, qualified professionals, or appropriate authorities immediately.

5. AI Content and Parent Review

Stories, images, prompts, narration, hero recommendations, safety messages, and other outputs may be generated or assisted by AI. AI systems can make mistakes. All content must be reviewed by an adult before being shown, read, relied on, shared, or saved for a child.

You are responsible for the prompts and information you submit and for how you use generated content.

6. Acceptable Use

• Do not use TheraTale to create, request, store, or share sexual, exploitative, violent, hateful, abusive, discriminatory, illegal, self-harm, weapon, drug, or child-harm content.
• Do not submit unnecessary sensitive data about children or other people.
• Do not attempt to bypass safety systems, reverse engineer the service, attack infrastructure, overload systems, scrape content, or use the service for commercial resale without permission.
• Do not violate privacy, intellectual property, app store rules, or applicable laws.

7. Subscriptions, Billing, and Refunds

Paid access, if offered, is managed through Apple App Store or Google Play. Store terms, billing rules, renewal settings, cancellation procedures, taxes, and refund processes are controlled by the applicable store.

TheraTale does not collect full payment card details and cannot guarantee refunds outside applicable store rules or mandatory legal rights. Subscription benefits, pricing, and availability may change.

8. Intellectual Property and Generated Content

The TheraTale brand, designs, characters, hero universe, software, visual style, story structures, website, and related assets are owned by or licensed to TheraTale.

You receive a limited, personal, non-transferable, revocable license to use the service for personal and family purposes. Generated stories, images, and narration are provided for personal and family use unless the app expressly says otherwise.

AI-generated content may resemble other content by coincidence and may not be unique, exclusive, copyrightable, or free of all third-party claims in every jurisdiction.

9. Availability and Changes

The service may be modified, suspended, limited, or discontinued for maintenance, safety, legal, business, app store, technical, or security reasons. Features, heroes, languages, image generation, narration, subscription benefits, and availability may change over time.

10. Disclaimers

To the maximum extent permitted by law, TheraTale is provided “as is” and “as available,” without warranties of any kind. We do not warrant uninterrupted operation, error-free output, perfect safety filtering, suitability for a particular child, merchantability, fitness for a particular purpose, non-infringement, or that AI output will be accurate or appropriate.

11. Limitation of Liability

To the maximum extent permitted by law, TheraTale and its owners, operators, affiliates, contractors, and service providers will not be liable for indirect, incidental, consequential, special, punitive, exemplary, or loss-of-data damages; loss of profits; emotional distress; parenting decisions; reliance on AI output; user-submitted content; service interruptions; or third-party platform actions.

To the maximum extent permitted by law, TheraTale’s total liability for all claims relating to the service will not exceed the greater of the amount paid through app stores for TheraTale in the twelve months before the claim or USD 50.

Nothing excludes liability that cannot legally be excluded, including fraud, intentional misconduct, certain gross negligence, death or personal injury caused by legally recognized negligence, or mandatory consumer rights.

12. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless TheraTale from claims arising from misuse of the service, violation of these Terms, unlawful content, violation of another person’s rights, or unauthorized use of a child’s or third party’s information.

13. Governing Law, Language, and Contact

To the maximum extent permitted by law, these Terms are governed by the laws of Türkiye, without excluding mandatory consumer protections in your country of residence. Before starting a formal dispute, contact support@theratale.app so we can try to resolve the issue informally.

For unsupported languages, the English version applies. If translations conflict, the English version controls to the maximum extent permitted by law, except where mandatory local law requires otherwise.
